A growing number of states allow the cultivation, sale, possession, and use of medical or recreational marijuana. Currently, towns, cities, and counties use a wide variety of regulatory tactics to control marijuana businesses and activities, and those tactics break down into two broad groups — business licensing standards and zoning. Furthermore, most jurisdictions that permit some form of marijuana land use, use both.
This issue of Zoning Practice reviews local approaches to regulating medical and recreational marijuana land uses through zoning and business licensing requirements. It discusses how these options are being implemented both in jurisdictions that have legalized recreational marijuana as well as in those that have only legalized medical marijuana.
